HOW TO ENTER:  In order to participate in the Promotion and be entered in the drawing, an eligible Platinum Series Auto QR Code participant must complete an online entry form located via QR Code on the back of selected Platinum Series products and provide all required entry information, acknowledgements, and consents. Entry must be completed through Platinum Series Auto Survey website. Eligible participants who do not have access to a phone with a camera and internet service and wish to enter may email Platinum Series Auto at [email protected] for assistance.

Participants who choose to email must write that that they be entered into the Promotion, provide his/her complete name and telephone number in the body of the email, and “QR Code Survey Monthly Giveaway – Email Entry” in the subject line of the email, provide the required entry information, and provide the required acknowledgements and consents.

One entry per person. Eligible survey participants may only submit one entry into the drawing. An eligible entry submitted before the entry deadline for any monthly drawing will remain entered for the duration of the Promotion unless disqualified under these Terms and Conditions.

Participants who have made an error in submitting their entry may submit a subsequent entry to correct errors in the initial entry. Prior to the drawing, the entry list will be reviewed, all duplicate entries will be removed, and only the later submitted entry will be included in the drawing. Persons submitting multiple entries for reasons other than making good faith corrections may be disqualified from the Promotion.

An entrant may only win once during the Promotion. A winner in any monthly drawing will be removed from the entry list and will be ineligible for all future drawings.

ELIGIBILITY: You are eligible to enter the Promotion and participate in the drawing only if you meet all the following requirements at the time of entry and the time of any potential prize award:

1. You are a permanent legal US resident of the fifty (50) United States and/or the District of Columbia.
2. You are at least 18 years of age.
3. You are not a director, officer, employee or agent of Sponsor or their affiliates, parents, subsidiaries, professional advisers, advertising and promotional agencies other entities involved in this Promotion
4. You are not an individual who is an immediate family member of or who reside in the same household as any individual described previously.

The Promotion is subject to all federal, state, and local laws and regulations and is void outside of the fifty (50) United States, District of Columbia, and wherever else restricted or prohibited by law. By entering this Promotion, Entrants indicate their full and unconditional agreement to, and acceptance of, these Official Terms and Conditions and the decisions of the Sponsor which are final and binding in all respects. Winning the Monthly Prize (defined in the “MONTHLY PRIZE” section below) is contingent upon fulfilling all requirements set forth herein.

MONTHLY PRIZE(S):  One prize worth approximately $100 will be awarded per month in the months of the Entry Timeline in PROMOTION PERIOD section. The Official Winner will be notified of the specifics of each monthly prize and its accompanying terms and conditions at the time of the prize award. The value associated with the Monthly Prize(s) is taxable as income and the Official Winner is solely responsible for any taxes, including, but not limited to, all applicable federal, state and local taxes that become due with respect to the value of the Monthly Prize(s). The Sponsor, or a third party acting on its behalf, may be required to report the value of the Monthly Prize(s) to the Internal Revenue Service in the year the Monthly Prize(s) is received by the Official Winner; and, in such case, the value of the Monthly Prize(s) will be reported to the Official Winner and the Internal Revenue Service in the form of a Form 1099 and/or other applicable tax forms.

SELECTION:  The Official Winner of each monthly drawing will be randomly selected by Platinum Series Auto by Machimpex USA from among all eligible entries received before the deadline for entry associated with that drawing. Platinum Series Auto by Machimpex USA will use a random number generator (RNG) to conduct the selection.

For each monthly drawing, Platinum Series Auto by Machimpex USA will use the RNG to randomly select a group of numbered entries from the database. The group of numbered entries will include one potential winner plus a number of alternates. Platinum Series Auto and its agents and contractors will not provide any personally identifying information about any entrant as part of the random selection process.

Platinum Series Auto will contact the entrant whose numerical identifier is selected as the potential winning number after determining from its preliminary review that the potential winner appears eligible to win a prize. A potential winner may be required to verify actual purchase and other information confirming eligibility before being named as an Official Winner.

VERIFICATION: Platinum Series Auto by Machimpex USA will review and attempt to confirm potential winner information and eligibility prior to declaring an Official Winner for each prize.

Verification of all information and eligibility criteria must be established to the sole satisfaction of Platinum Series Auto before a potential winner is named an Official Winner or entitled to claim any prize.

A participant 18 years or older who is selected as a potential winner will be contacted by a Platinum Series Auto representative to initiate the verification process. Platinum Series Auto will use the contact information provided by the participant at the time of registration to initiate contact by email.

Platinum Series Auto must communicate by email with a potential winner to verify the potential winner’s eligibility to win.

A potential winner will have 24 hours from the time Platinum Series Auto sends its initial email communication to respond to Platinum Series Auto. A potential winner must respond by contacting Platinum Series Auto by email within the 24-hour period and at the email provided in the Platinum Series Auto communication. If the potential winner does not respond by email contact with Platinum Series Auto within 24 hours and as instructed, the potential winner will forfeit the chance to win any prize and Platinum Series Auto will select an alternate as the potential winner.

The burden of demonstrating eligibility on other criteria in a timely manner and to the satisfaction of Platinum Series Auto by Machimpex USA rests with the potential winner.

A potential winner who is determined by Platinum Series Auto to be eligible to win will be required to provide proof of identity to affirm eligibility on all other eligibility criteria prior to being declared an Official Winner. Platinum Series Auto will provide a potential winner with electronic or other means for establishing such proof in a timely manner and in any case prior to the scheduled Announcement Date for the drawing in question.

In the event that Platinum Series Auto determines at any point that a potential winner’s entry is invalid or ineligible, or if Platinum Series Auto is unable to contact a potential winner or unable to validate the winner’s eligibility based upon information provided by the potential winner, or if a potential winner does not wish to receive a prize, or refuses or fails to provide verification information satisfactory to Platinum Series Auto, or if a potential winner does not respond to the initial contact by Platinum Series Auto or otherwise does not provide information required to verify eligibility within the timelines set by Platinum Series Auto, Platinum Series Auto may deem the potential winner ineligible and the potential winner will forfeit any claim to prizes associated with the Promotion. Platinum Series Auto shall then select the next ranked alternate potential winner from among the alternates and commence the verification and confirmation process with the newly selected potential winner. Alternate winners shall continue to be selected in the same manner until an Official Winner for the drawing has been confirmed.

Platinum Series Auto will have a limited period of time to locate and verify the eligibility of potential winners due to the fixed monthly schedule for drawing and announcing Official Winners. The decision to deem a potential winner ineligible or finally to declare an Official Winner shall be at the sole discretion of Platinum Series Auto. A decision by Platinum Series Auto to declare a participant ineligible or disqualified for any reason shall be final and not subject to appeal.

Once Platinum Series Auto has to their own satisfaction confirmed a potential winner’s eligibility and compliance with these Official Terms and Conditions, Platinum Series Auto will declare a potential winner to be an Official Winner of the Platinum Series Auto QR Code Monthly Giveaway.

GENERAL RULES: Persons who do not meet the eligibility requirements defined in these Official Terms and Conditions are not eligible to enter or to win. By participating in the Promotion, all entrants agree to be bound by these Official Terms and Conditions, all final decisions of Platinum Series Auto, and all procedures established for the Promotion. Platinum Series Auto may void any Drawing without advance notice and conduct a new Drawing if Platinum Series Auto, in their sole discretion, determine it is necessary to maintain the integrity of the Promotion.

Entry deadlines, drawing dates, and announcement dates for the Promotion are subject to adjustment.

NON-QUALIFYING ENTRIES: Entries (a) containing general obscene, lewd, crude, vulgar, profane, defamatory or inappropriate text, including acts of violence or acts that appear to cause harm, and/or (b) containing other offensive content and/or any content expressing explicit, graphic or excessive indecent content that is or could be considered inappropriate, unsuitable, or offensive, and/or (c) containing and displaying third-party brands prominently and intentionally, or any materials that violate or infringe (or may infringe) any copyright (including, without limitation, music or artistic work), trademark, logo, or other mark that identifies a brand, entity or other proprietary right of any person living or deceased, including but not limited to rights of privacy or publicity or portrayal in a false light, and/or (d) otherwise violate these Official Terms and Conditions, as determined by Sponsor, in its sole discretion, shall be disqualified from the Promotion. Sponsor reserves the right to disqualify an entry with offensive content or material that it feels is inappropriate in any way. Late entries or entries sent via any other method than those stated above will not be accepted.

PUBLICITY OF WINNERS: An Official Winner’s participation in the Promotion and acceptance of the prize constitutes the Official Winner’s express permission for Platinum Series Auto and its agencies to use his or her name and likeness for advertising and promotional purposes, without compensation. Further, by accepting a prize, each Official Winner agrees to hold Platinum Series Auto and its agencies, employees, commissioners, owners, directors, officers, affiliates, subsidiaries, contractors, assignees and agents, harmless against any and all claims or liability arising out of the Official Winner’s participation in the Promotion and receipt and ownership or use of a prize.

By participating, Entrant agrees that their entry may be shared on social media sites or other websites by the Sponsor. By submitting an entry, Entrant grants Sponsor and its affiliated companies worldwide, non-exclusive, perpetual, irrevocable, royalty-free, unconditional, and fully paid-up rights to publicly perform, display, broadcast, or transmit the entry, in whole or in part, for promotion and marketing purposes worldwide in any and all forms of media, whether now known or hereafter devised, and to distribute (directly or indirectly through multiple tiers) the entry to Sponsor’s affiliates, its marketing agencies, and to third parties for these purposes. Without limiting the foregoing, each Entrant consents to have the Entrant’s entry made available for public viewing and/or comment on the Internet.

Each Official Winner assumes all liability for any injury or damage caused, or claimed to be caused, by participation in the Promotion or use or redemption of any prize. Platinum Series Auto and its agencies make no warranty, guarantee or representation of any kind concerning any prize (or any portion thereof) and disclaims any implied warranty.

INTERNET CONDUCT AND LIMITATIONS OF LIABILITY: Any attempt by a user, participant or any other individual to deliberately damage the Promotion website or undermine the legitimate operation of this Promotion, is a violation of criminal and civil laws. A person engaging in such conduct may be disqualified from the Promotion without notice and may face criminal prosecution or civil liability as permitted by law.

Platinum Series Auto and its agencies, employees, commissioners, directors, officers, affiliates, subsidiaries, contractors, assignees or agents are not responsible for late or incomplete or misdirected participant entries, or for incorrect, inaccurate or incomplete information associated with such entries, even if caused by failures in the entry website or online entry form, or by any of the equipment or programming associated with or utilized in this Promotion.

Platinum Series Auto and its agencies, employees, commissioners, directors, officers, affiliates, subsidiaries, contractors, assignees and agents are not responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, or communication failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilized in any aspect of the operation of the Promotion, which may include without limitation, inaccessibility or unavailability of the internet, the entry website or online entry form or any combination thereof; theft or destruction or unauthorized access of the website or the database of entries; any injury or damage to the participants or to any other person's computer(s) or smartphone related to or resulting from participating in this Promotion, or downloading materials from or use of the website.

Monthly Prizes are nontransferable to any entity or other person, including relatives or friends.

Platinum Series Auto, in its sole discretion, reserves the right to select or change the Monthly Prize(s) to be awarded as part of this Promotion or end the Promotion prior to all prize winners being drawn. If any discrepancy exists between these Official Terms and Conditions and other statements or materials or advertisements concerning the Promotion, these Official Terms and Conditions shall prevail. These Official Terms and Conditions are subject to review and may be amended or revised at any time at the sole discretion of the Platinum Series Auto.

NO LIABILITY: By participating, Entrants and Official Winner agree to release, discharge, indemnify and hold harmless the Sponsor, Instagram, and the Promotional Entities, and each of their respective officers, directors, employees, representatives and agents from and against any claims made by the Official Winner, Entrants, or any other third parties, related in any way to the operation of this Promotion as well as any other claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from receipt, acceptance, possession, misuse or use of the Monthly Prize(s); participation in any Promotion-related activity; or participation in this Promotion.

DISPUTES: Entrants agree that any and all disputes, claims, and causes of action arising out of, or connected with, the Promotion or the Monthly Prize(s) awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Massachusetts. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Terms and Conditions, an Entrant’s rights and obligations, or the rights and obligations of Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of Massachusetts, without giving effect to any choice of law or conflict of law rules (whether of Massachusetts or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Massachusetts.

PRIVACY: This website regularly runs sweepstakes/promotions that may request personal information from you including your: (a) Name; (b) Email address; (c) Phone number; (d) State or zip code (e) Age; (f) Gender; (g) Driver’s License. This personal information may be accompanied by questions relating to your opinion of features on our products as well as our products as a whole. The personal information we collect is used to contact you in the event that you are selected to win a prize from the sweepstakes/promotions, in addition to sending you special offers and other marketing material.

You have the option to opt-out of receiving special offers and marketing material by clicking the “unsubscribe” option located at the bottom on every marketing or special offer email. This will unsubscribe you from any future marketing emails or special offers.

We do not sell or otherwise share the information you provide to us via sweepstakes/promotions. This information is only used internally to compile anonymous statistics about our user base and to create a contact list for sending special offers and marketing material.

You have the right to not provide the information requested or can simply not enter our sweepstakes/promotion if you do not wish to provide us with your personal information.
